1. Where you have been accepted for employment with Potenxia, provision of your personal data to us is mandatory for the purposes outlined above, and failure to provide the same will potentially hinder you from enjoying Potenxia services

You have the right to access your personal data and request for correction of the personal data that might be inaccurate, obsolete, incomplete or misleading or if the personal data need to be updated. We as a data user may refuse to comply with your data access request if the circumstances fall under Section 32 of the PDPA.

3. You have the right to access and request for the deletion of your personal data by contacting us at inquiry@potenxia.my and subject to our review, your personal data will be deleted within 30 days upon such request. We as a data user may refuse to comply with your data deletion request if the circumstances fall under Section 32 of the PDPA or we are of the view that such request contravenes with our policies.

4. We will retain your personal data for the period of five (5) years from the creation of the Profile by you and as long as necessary to fulfil the purposes outlined in this Notice unless your personal data has been deleted in accordance to Item 4, Part 1 herein. The criteria used to determine our retention periods may include one or more of the following:
(a) as long as we have an ongoing or potential engagement with you;
(b) as required by a legal obligation to which we are subject; and
(c) as advisable in light of our legal position (such as with respect to the employment contract with you and the applicable statutes of limitations, litigation, audits, or regulatory investigations).
